1Who we are and what these Terms cover
1.1These Terms of Service ("Terms") govern your access to and use of the Fablecast platform at fablecast.co (the "Service"), operated by Fablecast Ltd ("Fablecast", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1.2If you do not agree to these Terms, do not use the Service. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. See clause 6 (Content Involving Minors) for the limited circumstances in which content depicting a minor may be uploaded.
2The Service
2.1Fablecast is a software-as-a-service platform that helps you create AI-assisted stories, short videos, and episodic series, using licensed third-party AI providers (currently including Atlas API and Anthropic’s Claude API). Fablecast does not develop or train the underlying AI models.
2.2The Service is provided on a credit basis: you purchase credits via Stripe and spend them to generate content. There is no subscription. Credit pack pricing is shown at checkout and does not form part of these Terms.
2.3We may modify, suspend, or discontinue any part of the Service at any time, including specific features or AI providers, and will give reasonable notice of material changes where practicable.
3Your account
3.1You must provide accurate registration information and keep your password secure. You are responsible for all activity on your account.
3.2We may suspend or terminate your account if you breach these Terms, misuse the Service, or if required by law or by a payment processor.
4Payment, credits, and cancellation rights
4.1All purchases are processed by Stripe. Prices are shown inclusive or exclusive of applicable tax as indicated at checkout.
4.2Credits do not expire. Refunds are handled under our separate Refund Policy, available at fablecast.co/uploads/legal/refunds.html.
4.3Right to cancel (UK/EU consumers). Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you ordinarily have 14 days from purchase to cancel a purchase of digital content for a full refund. Because credits can typically be used immediately, by clicking "Buy now" (or equivalent) you expressly request that we begin supplying the credits immediately and you acknowledge that, once you use any part of a credit pack, you lose the right to cancel that pack under these Regulations. Unused, unopened credit packs may still be cancelled within 14 days — contact us using the details in clause 12.
5Content you submit and content we generate
5.1"Input Content" means anything you upload or submit (including prompts and reference photos). "Output Content" means the story, video, image, or other material generated by the Service from your Input Content.
5.2You retain ownership of your Input Content. Subject to your compliance with these Terms and payment of applicable fees, we grant you a licence to use, reproduce, and share the Output Content generated from your own Input Content for your personal or (where stated in your plan) commercial use.
5.3You warrant that you own or have all necessary rights and consents (including the consent of any person depicted) to submit your Input Content, and that your use of the Service does not infringe any third party’s rights.
5.4We do not claim ownership of your Input Content or Output Content. We may use anonymised, aggregated data about usage patterns to improve the Service.
6Content Involving Minors
6.1You may only upload a photograph or other content depicting a person under 18 if you are that person’s parent or legal guardian, or have obtained verifiable consent from a parent or legal guardian, and the intended use is a lawful, non-sexualised, family-appropriate purpose (for example, a family story or birthday video).
6.2You must never submit, and the Service must never be used to attempt to generate, any content that sexualises a minor, places a minor in a sexualised or exploitative context, or otherwise endangers a minor’s safety, however the request is framed. We use automated and human review to detect and block such attempts.
6.3We report suspected child sexual abuse material to the National Crime Agency and/or NCMEC as required by law, and will suspend and may permanently ban any account involved, without refund, and cooperate with law enforcement.

7Acceptable use
7.1You must not use the Service to generate or distribute content that is illegal, infringing, defamatory, harassing, or that depicts a real person in a sexual, violent, or misleading context without their consent (including "deepfake" misuse). 7.2We may remove content, suspend accounts, and report unlawful activity to relevant authorities.
8Intellectual property
8.1The Service, including its software, "FableFlow Director" workflow tools, branding, and underlying technology (excluding your Input Content and Output Content and excluding the underlying AI providers’ models), is owned by Fablecast Ltd or its licensors and protected by intellectual property laws.
9Disclaimers and liability
9.1The Service is provided "as is". AI-generated content may be inaccurate, unexpected, or unsuitable for your purposes, and we do not guarantee any particular output.
9.2To the fullest extent permitted by law, our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be limited by law.
10Termination
10.1You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms, the AI Policy & Acceptable Use Policy, or as required by law.
11Changes to these Terms
11.1We may update these Terms from time to time. Material changes will be notified to you (for example, by email or an in-app notice) with reasonable advance notice before they take effect.
12Governing law and contact
12.1These Terms are governed by the law of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you may also be entitled to bring proceedings in your local courts under mandatory local consumer protection law.
