AI POLICY & ACCEPTABLE USE POLICY

1Purpose

1.1This policy explains how Fablecast’s AI features may and may not be used. It applies to everyone who uses the Service, and forms part of our Terms of Service. Breach of this policy may result in content removal, account suspension or termination without refund, and a report to law enforcement where required.

2How AI generation works on Fablecast

2.1Fablecast does not build or train its own AI models. Content you request is generated using licensed third-party AI providers (currently Atlas API and Anthropic’s Claude API), acting as our data processors. We apply our own moderation on top of, and in addition to, each provider’s own safety systems.

3Prohibited uses — general

You must not use Fablecast to create, upload, or attempt to generate content that:

4Content involving minors — zero tolerance

4.1Fablecast has a zero-tolerance policy for any content that sexualises, exploits, or endangers a minor (anyone under 18, or under the age of majority where higher in a relevant jurisdiction). This applies regardless of how a request is phrased, whether the minor is real or fictional, and whether the imagery is photographic, illustrated, or AI-generated.

4.2A photograph or likeness of a minor may only be uploaded by, or with the verifiable consent of, that minor’s parent or legal guardian, for a lawful, non-sexualised, age-appropriate purpose (for example, a family story, school project, or birthday video). We may ask for evidence of that consent at any time.

4.3We use a combination of automated screening and trained human review to detect attempted misuse involving minors, including attempts to reframe or disguise a prohibited request. Detected attempts result in immediate content blocking and account review, and — for content that may constitute child sexual abuse material — an immediate report to the National Crime Agency and/or the National Center for Missing & Exploited Children (NCMEC), preservation of relevant records as required by law, and permanent termination of the account without refund.

4.4Anyone can report suspected misuse involving a minor to safety@fablecast.co, or via the "Report content" link available on every generated item, reviewed as a priority.

5Likeness and consent

5.1You may only upload a photo or likeness of another adult if you have their permission to do so and to generate content from it. Do not upload images of people who have not agreed to appear in Fablecast-generated content.

6AI transparency and labelling (EU AI Act, Article 50)

6.1Our AI providers do not currently apply their own visible or machine-readable marking to raw generated content. Fablecast applies its own "AI Generated" or "AI Modified" label to content as described in clause 6.2. If any AI provider begins applying its own machine-readable marking in future, we will update this policy and ensure our export pipeline preserves it.

6.2Before generating or exporting content that realistically depicts, or could reasonably be mistaken for, a real person, place, or event ("Realistic Content"), you will be asked to confirm whether the content is intended to resemble reality. Where you confirm this, Fablecast automatically applies a visible "AI Generated" or "AI Modified" label to the exported file, using the icon set published by the European Commission, unless the content falls within the fictional/artistic exemption in clause 6.4.

6.3If you publish or share Output Content outside Fablecast in a professional, commercial, or public capacity (including on social media, in advertising, in journalism, or in e-commerce listings), you are responsible for keeping any applied AI label intact and for ensuring the content otherwise complies with Article 50 of the EU AI Act and equivalent transparency laws in your jurisdiction. This obligation does not apply to purely private, non-professional use (for example, sharing a family video on a personal account).

6.4Content that is clearly and obviously fictional, fantastical, or artistic (for example, characters, creatures, or settings that no reasonable viewer would mistake for reality) is not required to carry an AI label, but must still comply with the rest of this policy.

6.5You must not use Fablecast to:

6.6We may take technical and moderation steps to verify that the Realistic Content confirmation in clause 6.2 is being used accurately, including automated and manual review of export requests.

7Enforcement

7.1We may remove content, warn, suspend, or permanently terminate an account for breach of this policy, without refund for terminations due to a breach. We cooperate with law enforcement requests made through appropriate legal channels.

7.2Decisions can be appealed by emailing ceo@fablecast.co, except where the account was terminated for content involving the exploitation or endangerment of a minor, which is not eligible for appeal or reinstatement.

8Changes to this policy

8.1We may update this policy as our moderation practices, AI providers, or the law evolve; the "last updated" date above reflects the latest version.
